Report Title: Legal and Ethical Considerations in Cross-Border Data Transfers and Sharing

Report Abstract:The transfer of research data across borders is complex because countries and sectors may have very different rules and practices that need to be resolved as much as possible through formal, written agreements. We will examine several sources of international law relating to research data, including treaties, intergovernmental organizations, customary law, general principles, and other legal evidence. The principles on the ethical management of research data may be incorporated in these international legal instruments from the top down or developed from the bottom up. The presentation will end with a summary of the value of open data sharing.
